IUD perforation

I had a Mirena inserted 3 weeks ago. On my follow up they were unable to locate the strings. Well that's because the CNM who did the procedure told me she was going to tuck the strings in I thought to myself. But how do I do a self check if the strings are tucked in. A question I should have asked when the original procedure was done. Anyway I was sent for an ultrasound and still no luck. So now its back to the office for a pregnancy test because an xray is now in order. Great the xray shows the IUD is floating around in my pelvic vault. Has this happened to anyone else out there? Now I need surgery to get it removed. Do I have any legal recourse in a situation like this. I know there are perforation risks, but only 3 weeks have elapsed.

Dear Anon,

I am truly very sorry you now require surgery due to perforation. I know that what you were searching for was a contraceptive that made your life easier and instead a short 3 weeks after the insertion of Mirena you realize you are not only not being protected but that you require surgery.

This is not legal advice, but I did get this straight from their website:
Perforation. Mirena may go through (perforate) the uterine wall. If your uterus is perforated, Mirena may no longer prevent pregnancy. It may move outside the uterus and can cause scarring, infection or damage to other organs. Surgery may be needed to have Mirena removed.
So, I am not really sure that you may have any legal case when the side effect is clearly stated :-(
