It's always best to use condoms during any genital to genital contact. Accidents can happen at any time.
Pre-ejaculate fluid itself does not contain sperm. If a male has had a recent ejaculation, sperm can remain in the urethra (the tube that both semen and urine pass through). Once he urinates, sperm is flushed out.
