No, a man can't penetrate the urethra, which is where your urine comes out. It is a very, very small hole, and the vagina is much larger. No one could "mistake" the urethra for the vagina; it's way too small.
Here's a good diagram of female anatomy. You can see that, from this side view, the urethra is in front of the vagina and comparitively is quite small:
